Pricing Structure

Our standard hourly rates are as follows:

•Tracey Rothwell $479.38 (incl GST);

•Belinda Johnston $360.80 (incl GST);

•Bradley Littlejohn $249.70 (incl GST).

•Kylie Musgrove $206.80 (incl GST).

Litigation

As a consequence of our many years experience, we have found that it is possible to estimate costs of various stages of litigation.  Within seven days of a defence being received, Rothwell Lawyers will consider the issues raised in the defence and provide a litigation budget.  The litigation budget sets out anticipated costs for the following stages:

•Receipt of defence to end of discovery;

•Attendance at directions hearings;

•Mediation stage;

•Preparation for trial;

•Trial.

We have found that the estimates are fairly accurate, allowing our clients the abbility to budget and meet their legal bills.  There are no unpleasant suprises.

Where a costs order has been awarded, Rothwell Lawyers recommends that the costs be taxed so that an order for payment is obtained.  Although this is not a final order for the purposes of the Bankruptcy Act 1966, it maybe sufficient to found a bankruptcy notice or serve a statutory demand pursuant to the Corporations Act 2001.  Further the Supreme Court and County Court Rules provide that where a defendant fails to pay costs, it may strike out its defence (Order 63.03).  In circumstances where the Defendant continually defaults, then we will make an application pursuant to this Order.  We aim to place as much pressure on the defendant as allowed by the Court Rules to make litigation difficult for the defendant in an attempt to bring about a timely ending to litigation.

By providing litigation budgets, not only are our clients aware of anticipated costs, this information assists our clients in the preparation of its own internal budgets

If is appears for whatever reason that the litigation budget for that stage will be exceeded, our client is informed in writing immediately.
